Terms of sale

1. General Provisions

1.1 The owner of the online store www.pmkaubamaja.ee (hereinafter referred to as “Põllumehe Kaubamaja e-store”) is SE Tehnikakeskus OÜ (registry code 11102347), located at Nulu 1, Sauga small borough, Tori municipality, Pärnumaa 85008, Estonia.
1.2 Purchases can be made from the e-store:
1.2.1 As a private individual.
1.2.2 As a legal entity. Business customers can register -  Register and then add company details.

2. Validity of the Sales Agreement, Product and Price Information

2.1 These terms and conditions apply when purchasing products from Põllumehe Kaubamaja e-store.
2.2 Prices of products sold in the e-store are indicated next to the products. All prices include 24% VAT. Shipping fees are added to the product price.
2.3 The e-store reserves the right to adjust product prices in case of human error in entering the price or technical mistakes. In such cases, the e-store reserves the right to cancel the sale and refund the customer within 7 business days.
2.4 Shipping costs depend on the buyer’s location and the chosen delivery method. Shipping costs are shown to the buyer during order placement.
2.5 Product information is provided in the e-store next to each product and is regularly checked and updated.
2.6 Product images may be illustrative.

3. Placing an Order

3.1 To order products, add the desired items to the shopping cart. Fill in the required fields and select a suitable delivery method. The total amount due will then be displayed and can be paid via bank link or another payment method.
3.2 Products requiring special handling during transport are marked. Adding such products to the cart includes a "special handling fee" in the shipping cost.
3.3 Products marked as too large cannot be delivered via parcel machines.
3.4 Cart buttons have a defined value. Quantities up to 5 are displayed. Quantities above 5 are displayed as ">5". Any quantity can be added to the cart. If the desired quantity exceeds stock, the delivery time for the missing items is shown.
3.5 The agreement takes effect once the payment is received in SE Tehnikakeskus OÜ’s account.
3.6 Orders are processed and delivered only after full prepayment.
3.7 If the ordered product cannot be delivered due to unavailability or other reasons, the buyer will be informed as soon as possible and the payment (including shipping fees) will be refunded within 14 days of notification.

4. Delivery

4.1 Products are shipped within Europe.
4.2 Shipping costs are borne by the buyer and are displayed at the selected delivery method.
4.3 Domestic shipments in Estonia generally arrive within 3–7 business days from the conclusion of the sales agreement. Delivery times within Europe may vary depending on the country. If delivery within the agreed time is not possible, Põllumehe Kaubamaja reserves the right to extend the delivery period.
4.4 Products can also be picked up in person at Põllumehe Kaubamaja store at Nulu 1, Sauga. For this, select the “Pick up in person” option in the e-store. After payment and order preparation, the customer will be notified via SMS or email when the product is ready.

5. Gift Card Terms

5.1 Gift cards have a nominal value of €20 and can be used as a payment method up to the card’s total value in the Põllumehe Kaubamaja store or e-store (www.pmkaubamaja.ee).
5.2 The value of a gift card or any unused portion cannot be refunded or exchanged for another gift card, nor converted into cash.
5.3 If an order exceeds the available gift card balance, the difference must be paid using another payment method. Lost, stolen, or damaged gift cards are not replaced.
5.4 Gift cards are valid for 6 months from the date of purchase and must be used within this period.
5.5 The validity of a gift card cannot be extended.
5.6 Ownership and risk of loss of the gift card transfers to the buyer upon purchase.
5.7 Gift cards cannot be used to purchase new gift cards.
5.8 Each gift card can be used only once.
5.9 Põllumehe Kaubamaja is not responsible for lost, stolen, damaged, or unauthorized use of gift cards.

6. Right of Withdrawal

6.1 After receiving the order, the buyer has the right to withdraw from the contract within 14 days.
6.2 To exercise the 14-day withdrawal right, the product must only be used to the extent necessary to verify its nature, properties, and functionality as allowed for testing in a physical store. The returned product must be complete, including all items originally included in the package.
6.3 If the product has been used beyond what is necessary to verify its nature, properties, and functionality, or shows signs of use or wear, Põllumehe Kaubamaja may reduce the refundable amount according to the decreased value of the product.
6.4 Return shipping costs are borne by the buyer, except when the reason for the return is that the item does not correspond to the order (e.g., wrong or defective product).
6.5 Returned products must be unused and in their original packaging, which must be intact and clean. The product must retain its full commercial appearance.
6.6 The e-store will refund the buyer within 14 days of receiving the returned product.
6.7 The e-store may refuse refunds until the returned product has been received.
6.8 The e-store has the right to withdraw from a sales transaction if the product’s price was significantly below market value due to an error.

7. Right to Claim

7.1 The e-store is responsible for any non-conformity or defects present at the time of delivery and discovered within two years from delivery. For the first six months, any defect is presumed to have existed at delivery unless proven otherwise by the e-store.
7.2 The e-store is not responsible for damage caused by improper use, normal wear and tear, or deterioration caused by the buyer.
7.3 The buyer must notify the e-store of any defect within two years via email: info@pmkaubamaja.ee.
7.4 The e-store is not responsible for defects that occur after delivery.
7.5 If a purchased product has a defect for which the e-store is responsible, the e-store will repair or replace it. If repair or replacement is not possible, the e-store will refund the payment.
7.6 The e-store will respond to the consumer’s complaint in writing or in a reproducible form within 14 days.

8. Direct Marketing and Personal Data Processing

8.1 Personal data (name, phone number, address, email, bank details) provided by the buyer is used only to process the order and deliver the products.
8.2 Personal data may be shared with delivery service providers.
8.3 The e-store may send newsletters and offers to the buyer’s email if the buyer has opted in on the website.
8.4 The buyer can unsubscribe from promotional emails at any time by notifying the e-store via email.

9. Dispute Resolution and Liability

9.1 Complaints regarding the e-store must be sent to info@pmkaubamaja.ee.
9.2 If a dispute cannot be resolved amicably, the buyer may contact the Consumer Dispute Resolution Committee. The Committee has the authority to resolve disputes arising from contracts between the buyer and the e-store.
9.3 The e-store is liable to the customer, and the customer is liable to the e-store, for damages caused to a third party by violating these terms to the extent provided by Estonian law.
9.4 The e-store is not liable for damages or delivery delays caused by circumstances beyond SE Tehnikakeskus OÜ’s control or foreseeable events (force majeure).
